Terms of Service
Effective Date: 20 October 2025
These Terms of Service (“Terms”) govern your access to and use of the platform, website, and services provided by Travaya, part of Suura LLC-FZ (“Travaya,” “we,” “us,” or “our”). By accessing or using our website, creating an account, or booking a photoshoot (the “Services”), you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Who We Are & How Our Marketplace Works
Travaya operates an online marketplace that enables customers (“you” or “Customer”) to discover and book photo shoots with independent professional photographers (“Photographers”). Travaya does not itself provide photography services. Photographers are independent contractors, not employees or agents of Travaya. When you make a booking, you enter into a service agreement for photography services directly with the assigned Photographer. Travaya is authorized to collect and process payments on the Photographer’s behalf and to issue refunds in accordance with these Terms and our posted Refund & Cancellation Policy.
2. Accounts & Eligibility
You may need an account to use certain features. You are responsible for providing accurate information and for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. The Services are intended for individuals 18+ (or the age of majority in your jurisdiction). If you are under the applicable age, you must have parental or guardian consent.
3. Bookings, Pricing & Payments
All bookings are subject to Photographer availability. Prices listed on the site are in the currency indicated and may be subject to exchange-rate differences, bank charges, and taxes. Payment is due at the time of booking via our payment processor (e.g., Stripe). Certain processor fees retained by third parties may be non-refundable; see the Refund & Cancellation Policy for details.
Where applicable, you are responsible for any permits, entry fees, or location charges. If a private venue denies Photographer access or requires an unarranged fee, the session may be moved to a public location (subject to availability). If no alternative is accepted, the situation is treated as a Customer cancellation under the refund rules below.
4. Refunds, Rescheduling & Late Arrivals
We understand plans can change, but your Photographer reserves the requested date and time exclusively for you. Our policy balances client flexibility and Photographer protection:
- 90+ days before shoot: Full refund.
- 30–89 days: Full refund minus USD 50 administration fee.
- 7–29 days: 50% refund.
- 1–7 days: No refund.
Rescheduling: We will try to accommodate rescheduling requests. Requests made more than 14 days before the shoot are typically at no cost. Within 14 days, rescheduling depends on availability; if not possible, the cancellation rules above apply.
Late & No-Show: A 15-minute grace period applies. Time lost due to late arrival is forfeited and your delivered image count may be reduced proportionally. Failure to attend within the scheduled window is considered a no-show and is non-refundable.

5. Weather, Safety & Location Access
When the weather is light (for example, light rain or wind), the photographer will decide whether it’s still possible to do the shoot safely and get good results. The Photographer may propose a reasonable change of time or location to protect equipment and image quality. If no viable alternative exists, Travaya will issue a full refund to the original payment method. You are responsible for complying with local rules, permits, and any venue policies.
6. Deliverables & Editing
Unless stated otherwise on your booking page, your package includes professionally edited images delivered via an online gallery. RAW files are not included as standard and may be offered at Travaya's discretion at an additional fee. One round of edits (e.g., color/exposure/blemish touch-ups) is included; additional retouching can be purchased on request.
7. Intellectual Property & Publicity Rights
7.1 Photographer’s Copyright & License to Travaya
The Photographer owns all copyrights in the images created during your session. The Photographer grants Travaya a worldwide, perpetual, non-exclusive, transferable, sublicensable, royalty-free license to host, reproduce, display, adapt, edit for format/placement, distribute, and otherwise use the images for:
- Operating the platform and delivering the Services (e.g., gallery hosting and delivery to the Customer);
- Travaya’s own marketing and promotional purposes, including but not limited to our website, portfolio pages, emails, paid and unpaid advertising, and social media channels; and
- Showcasing Photographer portfolios within the Travaya ecosystem.
7.2 Customer Personal-Use License
Upon full payment, Travaya grants you a perpetual, worldwide, non-exclusive, non-transferable license to use the delivered images for personal use (e.g., printing, sharing on personal social media). Commercial use (e.g., promoting a business, paid advertising, product packaging) requires a separate commercial license available on request.
7.3 Travaya’s Right to Use Client Photos Unless You Opt Out
To inspire future travelers and to promote our community, Travaya may display and use selected images from your session on our website, social media channels, emails, and advertisements by default. If you do not want your images used for Travaya’s marketing or publicity, you must notify us before the shoot by emailing [email protected] with the subject line “Do Not Share” and your booking ID. We will honor your request for future use; already-published materials may not be fully retractable, but we will cease further use.
Note: In jurisdictions where explicit consent is required for certain marketing uses of personal images (e.g., some EU scenarios), Travaya will obtain that consent at checkout for those purposes.
7.4 Travaya & Customer Credits
When you share images publicly online, please credit Travaya where space and platform norms allow.
8. Content You Provide & Feedback
If you submit text, reviews, or feedback (“User Content”), you grant Travaya a worldwide, perpetual, non-exclusive, transferable, sublicensable, royalty-free license to use, reproduce, display, adapt, and distribute such content for operating, improving, and promoting the Services. Do not submit content you do not have the right to share. You are solely responsible for your User Content.
9. Acceptable Use
You agree not to misuse the Services, interfere with their operation, attempt to access non-public areas, or introduce malware. You may not copy, scrape, or frame our site or services without permission. We may suspend or terminate access for suspected fraud, abuse, or violations of law or these Terms.
10. Privacy
Your use of the Services is subject to our Privacy Policy, which explains what data we collect, how we use it (including server-side analytics, Google Ads/Meta Ads), and how we share data with the assigned Photographer to fulfill your booking.
11. Third-Party Services & Links
The Services may link to third-party websites or use third-party tools (e.g., payment, email, analytics). We are not responsible for third-party content or practices. Your use of third-party services is governed by their terms and privacy policies.
12. Disclaimers
The Services and all site content are provided “as is” and “as available.” To the maximum extent permitted by law, Travaya disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
13. Limitation of Liability
To the maximum extent permitted by law, Travaya’s aggregate liability arising out of or relating to the Services shall not exceed the total amount you paid for the affected booking. Travaya shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including lost profits, lost data, loss of goodwill, or business interruption).
14. Indemnification
You agree to indemnify and hold harmless Travaya and its officers, directors, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your: (a) breach of these Terms; (b) violation of law or third-party rights; (c) failure to obtain permits or venue permissions; or (d) misuse of the Services.
15. Force Majeure
Travaya is not liable for delays or failures due to events beyond our reasonable control, including but not limited to natural disasters, extreme weather, strikes, acts of government, internet or utility failures, civil disturbances, or other force majeure events.
16. Changes to Terms
We may update these Terms from time to time. The version in force at the time of your booking applies to that booking. For new site use or future bookings, the updated Terms take effect on their stated effective date. We encourage you to review this page periodically.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of the Dubai International Financial Centre (DIFC). The courts of the DIFC shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Services. If you are a consumer resident in a jurisdiction that mandates specific consumer venue rights, you retain any non-waivable rights under applicable law.
18. Miscellaneous
Entire Agreement. These Terms, along with the Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and Travaya regarding the Services.
Severability. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Electronic Communications. You consent to receive emails and electronic notices related to your bookings and the Services.
